Щодо визначення сутності злочинної діяльності

Abstract

У статті розглянуто та проаналізовано погляди вчених на визначення поняття «злочинна діяльність». З’ясовується сутність злочинної діяльності, оскільки це має важливе значення для визначення основних напрямків боротьби з нею, встановлення засобів протидії, а також попередження. Розглядаються змістовні елементи злочинної діяльності– мета, об’єкт, суб’єкт, засоби та процес діяльності, а також обґрунтовано, що для підвищення ефективності боротьби зі злочинною діяльністю потрібно вивчати її як соціальний феномен, як один із різновидів соціально значущої людської діяльності. The article discusses and analyzes the views of scientists on the definition of the concept «criminal activity». The importance is placed on the essence of criminal activity, because it is important for determining the main directions of struggle against it, establishing means to counteract and prevent it. The article seeks to substantiate the principal elements of the criminal activity – purpose, object, subject, tools and the process of activities. It has been proved that to improve the effectiveness of struggle against criminal activity scholars should study it as a social phenomenon, as one of the varieties of socially significant human activity. The criminal activities have their development sequence, inherent elements of professionalism and organization. Therefore, to fightcrime effectively all the aspects should be taken into account but not to focus only on certain types of crimes. Recognizing the existence of such phenomena as socially dangerous criminal activity, studying and analyzing it, watching its development, provides possibility to develop effective ways of counteracting criminal activity. The reference to the historical experience is of great importance on the way of improving strategies, methods and means of fighting the crime.
