Тенденції розвитку та удосконалення аграрного законодавства України

Abstract

У статті висвітлено проблеми та перспективи розвитку аграрного законодавства в умовах сьогодення. Проаналізовано питання систематизації законодавства як засобу підвищення ефективності правового регулювання аграрних відносин в Україні. У статті висвітлено проблеми та перспективи розвитку аграрного законодавства в умовах сьогодення. Завдання систематизації аграрного законодавства буде повною мірою досягнуто лише за умови поєднання різних форм систематизації й дотримання черговості їх застосування стосовно законодавчих і підзаконних нормативно-правових актів, які містять аграрно-правові норми. Результатом систематизації аграрного законодавства має стати розробка нового за формою й змістом Аграрного кодексу України. Обґрунтовано окремі пропозиції щодо вдосконалення аграрного законодавства України. The article tackles the problems and perspectives of development of agrarian law in modern conditions. The author suggests that the task of systematization agrarian legislation will be fully achieved only when various forms of systematization and the principle of priority of their application can be combined regarding legislative and regulatory regulations that agro-law includes. The process of systematization of agrarian legislation should be begun with registration – activity aimed at collection, storing and maintaining the norms of agrarian legislation under control. It might be appropriate to incorporate the agrarian legislation that will help to identify the totality of regulations that regulate agrarian relations. The next step should be legislative consolidation of the agrarian legislation, which finds its reflection in the combining in one two or more similar in subject and method of regulation agricultural legal acts. The author concludes that only then it is advisable to switch to prudent realization of codification of agrarian legislation, that is substantial transformation of normative material and, as a result, developing a new form and content of the Agrarian сode of Ukraine.
