Конституційні та інституційні засади захисту прав дитини в Україні та Польщі: порівняльно-правовий аналіз

Abstract

Стаття присвячена дослідженню конституційних засад і інституційного досвіду захисту основоположних прав і свобод дитини в Україні та Польщі. Обґрунтовується зміст категорії«захист прав дитини». Аналізуються нормативно-правовий і організаційний механізми захисту прав дитини в Україні та перспективи їх удосконалення, з огляду на позитивний зарубіжний досвід. Висвітлюються особливості конституційного регулювання прав дитини в Конституції та законах Польщі, а також діяльність Захисника прав дитини. Робиться висновок про перспективність віднесення інституту дитячого омбудсмана до системи парламентського контролю у сфері прав людини. The article highlights the constitutional framework and institutional experiences in protection of the fundamental children's rights in Ukraine and Poland. The study contributes to understanding of the content of the category «children's rights» and provides analysis of the legal and organizational mechanisms of child rights protection in Ukraine, reveals the prospects of their improvement in view of the positive international experience. The author lays emphasis on the peculiarities of constitutional regulation of children's rights in the Constitution and the legislature of Poland, the responsibilities of the Defender on thechild’s rights. The conclusion is made about the prospects of including Institute of Child Ombudsman system into the parliamentary control system in the domain of human rights. An important criterion of effectiveness of children's ombudsman activity is the availability of his defense due to the awareness of children about this institution and its human rights protection potential. In Poland, children first learn about Child Rights Defender from the books, letters from the Ombudsmanto the children which are announced by the headmastersof all the schools at the beginning of a new academic year, as well as from numerous television and radio programs, social networks and so forth. In Ukraine, unfortunately, the children's ombudsman does not enjoy similar media support. Elimination of these shortcomings can be the first step in the popularization of children's ombudsman legal powers.
