Конституційна правосуб’єктність суддів як основа їх конституційно-правового статусу: теоретико-правовий аналіз

Abstract

У статті визначаються загальні положення конституційної правосуб'єктності та її складові. Підкреслюється, що конституційна правосуб'єктність є основним, базовим елементом конституційно-правового статусу судді. Саме вона зумовлює можливість судді бути учасником конституційних правовідносин та визначає обсяг його прав та обов'язків.The general positions are determined of the constitutional legal subjectivity of its constituents are presented in the article. The constitutional legal subjectivity is the main basic element of the constitutional and legal status of the judge is emphasized. It makes the possibility of the judge to be a member of the constitutional relationship and defines the scope of of its rights and obligations.
