Щодо особливостей застосування в Україні заходів безпеки до осіб, засуджених до довічного позбавлення волі

Abstract

У статті на основі вивчення правового статусу осіб, засуджених до довічного позбавлення волі, обґрунтована необхідність посилення заходів безпеки, що застосовуються до зазначених категорій засуджених у ході виконання даного кримінального покарання. Проведений аналіз наукової літератури дає можливість зробити висновок про те, що допоки на доктринальному та практичних рівнях не буде доведена необхідність збереження довічного позбавлення волі та, одночасно, повної відміни смертної кари, доти це буде визначальною обставиною, що детермінує особливості змісту заходів посиленого характеру, які спрямовані на забезпечення особистої безпеки усіх учасників кримінально-виконавчих правовідносин. Це у повній мірі стосується й заходів безпеки, що застосовуються до засуджених значеної категорії осіб у визначених у ст. 106 Кримінально-виконавчого кодексу України випадках.On the basis of the study of the legal status of persons sentenced to life imprisonment the authors place importance on the necessity of strengthening security measures applicable to these categories of prisoners during the execution of criminal penalties. The analysis of scientific literature makes it possible to conclude that as long as the need to preserve life imprisonment and until the complete abolition of the death penalty has not been approved at the doctrinal and practical levels, until then it will remain the crucial factor that determines the intensified character of the content of management features, aimed at protecting the personal safety of all participants of criminal-executive relationships. This provision also includes the security measures applied to the convicted to life imprisonment persons which are specified in Art. 106 of the CEC cases. Moreover, the current legal realities of normative legal nature, aimed at modification of the content of life imprisonment, not only complicate the solution of security problems of the colonies personnel and other persons involved in the process of the sentence execution, but in general, the security of the state and the whole society.
