Окремі питання проведення судової комп’ютерно-технічної експертизи у кримінальному судочинстві

Abstract

Розглянуто окремі питання призначення й проведення судової комп’ютерно-технічну експертизи у кримінальному судочинстві, об'єкт і предмет даного роду експертизи, види і можливості СКТЕ, окреслено деякі організаційні і методичні проблеми у використанні новітніх науково- технічних засобів. Розкрито проблеми науково-методичного забезпечення судової комп’ютерно- технічної експертизи. The article deals with certain issues of appliance and conducting a judicial computer-technical expertise in criminal proceedings, object and subject matter of this kind of expertise, types and possibilities of judicial computer-technical expertise. The author outlines some organizational and methodological problems in using the latest scientific and technical facilities and reveals the issues of scientific and methodological support of judicial computer-technical expertise. It is concluded that at the present stage the specificity of conducting a judicial computer-technical expertise opens new opportunities for the development of state policy in the field of providing information security and counteracting cyber crimes. In this regard, the dominant tendencies of judicial computer-technical expertise development should be: harmonization of methodological materials with the international practice; creation of equal conditions for forensic expert activity for both state and non-state expertise institutions; consolidation of efforts of all subjects who utilize special knowledge in the field of computer-technical expertise, improvement of scientific, methodological and information support of forensic expert activity. The effective implementation of these processes depends greatly on the quality of the expertise proceedings, due to the professional level of forensic experts.
