Ювенальна юстиція як необхідний захід захисту основних прав неповнолітніх

Abstract

У статті розглядається питання введення ювенальної юстиції у справах неповнолітніх. Аналізуються тенденції формування правової політики України. Зроблено висновки про те, що у сучасних умовах потрібне створення особливої програми, що включає в себе побудову цілісної системи ювенальної юстиції, де будуть прийняті нові закони і воєдино з'єднані всі елементи правозахисту: ювенальні суди, правоохоронні органи, служби пробації та реабілітації, державні та інші організації. В таку систему повинні входити соціальні та соціально-педагогічні служби, ювенальна прокуратура, навчально-виховні та медичні корекційні установи, установа спеціального омбудсмена (омбудсмена з прав дітей) та інші громадські організації. The article highlights the prospects for the introduction of the juvenile justice into the system of juvenile delinquency prevention in Ukraine. One of the components of juvenile justice must be the institution of probation, which is conditioned by the objective need for humanization of the criminal justice sphere. The author analyzes the publications and scientific works on the issues of juvenile justice. On the basis of the empirical data the author substantiated the necessity of creating juvenile justice in Ukraine alongside with the bodies and services that have to perform competent functions in the sphere of children's rights protection. The emphasis is put on the legislative ways of implementing the re-socialization function of juvenile justice.
