Консульський захист прав та свобод громадян України за кордоном

Abstract

Проаналізовано адміністративно-правові механізми та ефективність забезпечення захисту конституційних прав, свобод та інтересів громадян України за кордоном. Висока динаміка міграційних процесів актуалізує дану проблематику. Розглянуто нормативно-правову базу діяльності консульських служб. Запропоновано рекомендації щодо підвищення ефективності діяльності консульських служб щодо захисту конституційних прав та свобод громадян за кордоном. Йдеться про необхідність підвищення професійної компетенції державних службовців, побудову діяльності консульських служб на засадах транспарентності. Існує необхідність посилення співпраці консульських установ з міжнародними й громадськими організаціями та благодійними фондами з метою вирішення питань правового захисту наших співвітчизників. The article elucidates the administrative-legal mechanisms and effectiveness of ensuring the protection of the constitutional rights, freedoms and interests of the Ukrainian citizens abroad. The high dynamics of migration processes actualizes this issue in the context of the normative legal basis of the consular service activity. The article considers the recommendations on improving the efficiency of the activities of consular services in protecting the constitutional rights and freedoms of Ukrainian citizens abroad. The most significant among them is the need to increase the professional competence of civil servants and to improve the consular service activity on the basis of transparency. There is also a need to strengthen cooperation of the consular institutions with international and public organizations, including charitable foundations, in order to solve the issues of the legal protection of the Ukrainian citizens abroad. Perspective for strengthening the institutional capacity to protect the rights and interests of the Ukrainian citizens abroad involves strengthening the interaction between consular offices and other bodies of state power and legal entities of public law that exercise powers in the field of migration (in cases provided for by law). The activities of consular institutions should also be aimed at informing citizens; establishing constant feedback with them; promoting educational exchange programs; raising awareness of the public about the possibilities of protecting their rights and freedoms abroad.
