Ідеї правової держави в історико-правовій ретроспективі

Abstract

Досліджено уявлення про правову державу в історії розвитку політико-правової думки. Уявлення про державу як про організацію, яка здійснює свою діяльність на основі закону, почали формуватися вже на ранніх етапах розвитку людської цивілізації.Теорія правової держави стала підсумком багатовікового розвитку політичного життя і правової думки багатьох країн світу. Українські автори концепції про державу і право були попереду багатьох мислителів Західної Європи з питань природного права, панування в державі закону, місцевого самоврядування та ін.Ukraine, having proclaimed its goal the formation of a lawful state, has set a range of problems connected with necessity of historical-legal and theoretical solution of urgent problems concerning its way of transformation. Conception of the state as an organization, that operates on the basis of law, started to take shape at the early stages of human civilization development. Ancient philosophers and legal scholars associated the state with law and substantiated the need for living in the state of legal laws, which would dominate the state structures, would be a criterion of justice of the state and its officials activities and regulate political relations. Early Christianity proclaimed the principle of equality of people regardless of their social origin, status and nationality. Ukrainian authors of the conception of state and law had been ahead of many Western European thinkers on the issues of natural law, the rule of law in the State, local self-governing and others. The theory of legal state was the result of many-centuries development of political and legal thought of many countries of the world.
