Пенитенциарная политика Российской империи в первой половине ХIХ века

Abstract

В статье анализируются историко-правовые аспекты пенитенциарной политики Российской империи в первой половине ХIX века. Аргументируются, с одной стороны, последствия попыток самодержавия отгородиться от буржуазных преобразований, государственно-управленческих новаций и, с другой стороны, причины, по которым эти преобразования осуществились. Сделаны выводы относительно эффективности дореформенного периода системы исполнения наказаний и ее влияния на дальнейшие реформы 1860-х годов.

The article analyzes the historical and legal aspects of the penal policy of the Russian Empire in the first half of the nineteenth century; on the one hand, the consequences of autocracy attempts to dissociate from the bourgeois transformation and innovations are discussed and, on the other hand, the reasons for these changes in the penal policy are discussed. The conclusions on the effectiveness of the pre-reform period of the penal system and its impact on further reforms of the 1860s are made.
