Щодо проблеми побудови характеристик злочинів

Abstract

Положення статті містять характеристику поглядів провідних учених-криміналістів які визначають проблеми побудови характеристик злочинів, проводиться аналіз окремих елементів криміналістичної характеристики. Висловлюється думка про можливість побудови кримінально-процесуальної характеристики злочинів. Також автор статті значну увагу приділив розробці власної характеристики злочинів для потреб теорії оперативно-розшукової діяльності.The article includes a characteristic of the views of criminalists, defining the problem of determining the features of crimes. Separate elements of the criminological characteristics are analyzed. The opinion about the possibility of constructing the criminal procedure characteristics of crimes is expressed. This thesis is analyzed and it’s noted there are significant differences between the definition of the range of circumstances and their characteristics, which is reasonable to explore in the future. A considerable attention of the author is devoted to developing his own characteristics of crimes in the theory of operatively-search activity because the features and elements of crimes are not reflected in other characteristics and are significant for developing recommendations for the detection and the prevention of crimes. On this basis, the author proposes changes and additions to the existing criminal procedural legislation of Ukraine, which is a positive step to approximation the legal regulation of criminal procedure activity with international standards and a higher level of human rights’ ensuring.
