Історичні та політико-правові аспекти виникнення і розвитку інституту конституційного контролю

Abstract

У статті досліджено виникнення, становлення та розвиток інституту конституційного контролю. З’ясовано, що становлення тієї чи іншої моделі конституційного контролю в країні пов’язане з особливостями національного права, організацією державної влади та економічними, політичними й історичними умовами. Охарактеризовано специфічні ознаки американської та європейської моделей конституційного контролю. Визначено основні особливості й відмінності цих моделей. Зазначено, що утворення й діяльність Конституційного Суду України стали можливими завдяки набуттю Україною незалежності та відходу її державно-правової думки від орієнтування на радянську практику. З’ясовано, що в Україні запроваджено європейську модель конституційного контролю. The article highlights the issues of emergence, establishment and development of the constitutional control institute. It has been revealed that the formation of this or that model of constitutional control in the country is coherent with the peculiarities of its national law, organization of the state power, economic, political and historical conditions. The article sheds light on the specific features of American and European models of constitutional control and discusses basic peculiarities and differences of these models. The author emphasizes that the establishment and activity of the Constitutional Court of Ukraine has become possible due to Ukraine's acquisition of independence and withdrawal of its state-legal policy from the Soviet practice principles. It has been revealed that Ukraine introduced a European model of constitutional control, which implies carrying out control by a specialized judicial body that is independent and not included within the system of courts of general jurisdiction.
